CNN Central News & Network-ITDC India Epress/ITDC News Bhopal: A petition filed in the Supreme Court over the law governing the appointment of the Chief Election Commissioner (CEC) and Election Commissioners was not heard on Thursday. Justice Dipankar Datta asked the petitioner to place the matter before the Chief Justice of India (CJI). The court said the listing of cases and the constitution of benches fall within the jurisdiction of the Chief Justice.
The application is linked to petitions challenging the 2023 law that provides for a three-member selection committee for the appointment of the Chief Election Commissioner and other Election Commissioners. Earlier, on September 23, 2026, a bench of Justice Dipankar Datta and Justice Satish Chandra Sharma had delivered differing opinions on whether the petitions challenging the law should be referred to a Constitution Bench. The matter was then sent to the Chief Justice.
The latest application sought recall of the September order. On behalf of the petitioner, it was also argued that the son of one of the judges on the bench appears for the Election Commission before the Madhya Pradesh High Court, and that this information was not available at the time of the hearing. On this ground, the petition sought review/recall of the order.
Justice Datta said all such applications and petitions would be decided by the Chief Justice and the matter would not be heard in separate parts. The next step will now depend on the matter being listed before the CJI.
