The Chamber claims that the exorbitant fee would render the H-1B program cost-prohibitive for many U.S. employers — especially startups, small, and mid-sized businesses — who rely on skilled foreign workers.
The suit contends that the administration is overstepping its regulatory bounds and undermining the visa program created by Congress to allow up to 85,000 foreign professionals annually to contribute to the U.S. workforce. According to the complaint, many member companies already employ H-1B visa holders and plan to continue sponsoring them; the Chamber says this grants it standing to sue. The group seeks an injunction to block implementation of the fee.
