The lawsuit, filed in Washington D.C., contests that the fee is unlawful and unconstitutional, arguing that it violates existing immigration statutes by exceeding executive authority.
According to the complaint, the fee dramatically inflates costs for businesses—especially startups and medium-size firms—and could stifle access to skilled foreign talent.
The Chamber contends that visa fees must reflect actual processing costs, not be used as punitive measures or revenue levers.
The administration, in its defense, says the fee targets new visa filings and excludes renewals or existing visa holders.
If the court rules in favor of the Chamber, the order could be blocked, reshaping U.S. immigration policy and its impact on the technology, research, and business sectors.
