CNN Central News & Network-ITDC India Epress/ITDC News Bhopal: In a dispute linked to land in Darain village of Shahdol district in Madhya Pradesh, the Chhattisgarh High Court has issued an important ruling on the jurisdiction of the civil court. The court upheld the order of the Janakpur civil court, which had accepted its jurisdiction to hear the matter. The High Court dismissed the petition filed on this ground.
In the case, one of the disputed properties is located in Shahdol district, while the other lands are in Ghatai and Kharika Tola in Chhattisgarh’s Manendragarh-Chirmiri-Bharatpur district. The petitioners argued that because the dispute involved land situated in Shahdol, a court in Chhattisgarh did not have the authority to hear the entire case. On this basis, they had raised an objection under Section 16 of the Code of Civil Procedure.
The Janakpur civil court had rejected the application on 10 August 2026. The matter then reached the Chhattisgarh High Court. The High Court held that when, among several immovable properties linked to the same suit, at least one property is located within the territorial limits of the concerned court, the entire dispute can be heard by that court. Following this ruling, the way has been cleared for the hearing related to the Shahdol land dispute to continue in Chhattisgarh.
