CNN Central News & Network-ITDC India Epress/ITDC News Delhi: A Delhi court has set aside a magistrate’s earlier order that had refused to direct registration of an FIR against Congress leader Sonia Gandhi over allegations concerning her inclusion in the electoral roll in 1980.
Special Judge Vishal Gogne of the Dwarka Courts directed that the matter be sent back to the magistrate for fresh consideration. The court said the earlier order did not provide adequate reasons and failed to follow the required procedure, including hearing the concerned police officer and seeking a status report.
The complaint, filed by Vikas Tripathi, alleges that Sonia Gandhi’s name appeared in the New Delhi electoral roll in 1980, although she acquired Indian citizenship in April 1983. The petitioner has sought registration of an FIR and investigation into the circumstances surrounding the alleged voter-list entry. These allegations have not been established by the court.
The court has directed the magistrate to examine the complaint afresh and pass a reasoned order after hearing the relevant parties and conducting the required inquiry. The matter is scheduled to come up before the ACJM on September 29.
Sonia Gandhi has previously denied the allegations and opposed the plea, describing it as politically motivated and based on speculative claims without foundational documents. Her response also questioned the use of decades-old records to initiate criminal proceedings.
The latest order revives the legal proceedings, but it does not itself direct registration of an FIR or establish the allegations against Gandhi.
