CNN Central News & Network-ITDC India Epress/ITDC News Bhopal: New Delhi. The Delhi High Court has clarified a relief route for people whose names were removed from the voter list during the Special Intensive Revision (SIR) of electoral rolls in Delhi. The court said affected voters can fill Form-6 to have their names included again in the electoral roll. The court also described as a misunderstanding the apprehension that, despite already being voters, they could face action for making a false declaration if they fill this form.

The matter related to a petition by two voters whose names had been removed from the electoral roll because the SIR enumeration process could not be completed. The petitioners said they had shifted from their old address to another place, due to which the process of filling the enumeration form could not be completed.

The petitioners had sought the option of Form-8 for the re-inclusion of their names. This form is generally used for corrections in the voter list, including name, address or other details, and for situations involving change of residence. Their argument was that by filling Form-6, they may have to declare that they were applying for inclusion in the voter list for the first time, whereas they were already registered voters.

A bench of Justice Dinesh Mehta and Justice Aditi Choudhary, while hearing the matter, took note of the suggestion made by the Election Commission’s counsel, who advised the affected voters to fill Form-6. The court said this suggestion, given on the instructions of the Electoral Registration Officer, made the apprehension of an allegation of false declaration baseless.

Disposing of the petition, the court said the petitioners may apply by filling Form-6 if they wish. Their applications will be considered in accordance with law. This does not mean that names will automatically be added to the voter list as soon as the application is submitted. The concerned authorities will examine the documents and eligibility and then take a decision as per rules.

Affected voters whose names have been removed during the SIR should first check their status in the official electoral roll. After this, they can obtain information about Form-6 and the related declaration from the official portal of the Election Commission or the Chief Electoral Officer of Delhi. If needed, they can also seek guidance from the booth-level officer or the Electoral Registration Officer.

The order is significant for voters who have voted earlier but are unsure about the process of re-registration after their names were removed during the revision. Voters should provide correct information in their applications and keep track of the status of their application.
