CNN Central News & Network–ITDC India Epress/ITDC News Bhopal/ Uttar Pradesh : In a landmark judgment, the Allahabad High Court ruled that an estranged wife has the legal right to receive the family pension of her deceased husband, even if the couple was not living together at the time of his death. The decision came while hearing a case where the deceased government employee’s wife was denied pension benefits due to separation.

The court clarified that estrangement or physical separation does not dissolve the marital relationship unless there is a formal divorce decree. As long as the marital bond is legally intact, the spouse is entitled to all posthumous benefits, including family pension. The bench noted that denying such rights on the basis of separation would be unjust and contrary to established pension rules.

This verdict is being seen as a progressive move in safeguarding the rights of women who remain legally married despite strained relationships. It reinforces the legal position that emotional or physical distance within a marriage does not nullify a spouse’s entitlements under government service rules.
