CNN Central News & Network–ITDC India Epress/ITDC News Bhopal: The Chief Medical and Health Officer (CMHO) Bhopal and the competent authority under the PCPNDT Act have filed a complaint in the Hon’ble District and Sessions Court regarding violations of the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of Sex Selection) Act. The complaint names three doctors along with diagnostic center operators as accused under the Indian Penal Code (IPC) 2023 and relevant sections of the PCPNDT Act, 1994.

In the complaint filed by the competent authority under the PCPNDT Act, Mohammad Danish Ali, son of Sarwar Ali, the operator of New Life Diagnostic Centre located on Airport Road, Gandhinagar, and radiologist Dr. Eeshant Jatav, son of Suresh Kumar Jatav, along with another case involving Marvel Hospital, have been named. In the Marvel Hospital case, the operator Vishal Srivastava, son of A. K. Srivastava, and Kriti Srivastava, wife of Vishal Srivastava, were also charged under Section 223 of IPC 2023 and Sections 28 and 23 of the PCPNDT Act, 1994, along with rules 9(1,4) and 9(1,4,8) of the PCPNDT Rules, 1996.

Earlier, considering the activities of these doctors to be suspicious and in violation of the PCPNDT Act, the CMHO Bhopal office had revoked the recognition of their institutions. CMHO Bhopal, Manish Sharma, personally appeared in the Hon’ble Court to submit the complaint against these doctors and diagnostic center operators. As per the Court’s order, cases under the statutory provisions will proceed against all of them.

It is noted that on January 22 this year, the CMHO office inspection team detected irregularities at the sonography center operated in Marvel Hospital. Form F was not being properly maintained, and entries in the ANC register were also incomplete. Based on these irregularities, documents were seized and the machine was sealed. At New Life Diagnostic Centre, blank Form F sheets bore the seals and signatures of Eeshant Jatav, and both ANC and Form F entries were found incomplete.

Upon identifying clear violations of the Act, the CMHO issued a notice to Eeshant Jatav and prohibited him from performing sonography until further orders. Additionally, the PCPNDT recognition of the center was revoked. The Hon’ble Court granted bail to all three doctors and the diagnostic center operators in the respective cases. Investigations by the Health Department will continue based on the details and facts submitted in the complaint.
