CNN Central News & Network-ITDC India Epress/ITDC News Bhopal: Kanpur. A fresh development has emerged in an alleged fake encounter case in Kanpur, Uttar Pradesh, dating back nearly 35 years. After an investigation, a first information report (FIR) has been registered against 12 police personnel. The action has been taken on the basis of an inquiry by the Crime Branch of the Crime Investigation Department (CBCID). The reopening of legal action in the old case has created a stir in the police department.

The facts emerging from the CBCID investigation are said to relate to an alleged encounter in 1991. It is alleged that during police action, a person was claimed to have been killed in an encounter, while questions were later raised over the circumstances of the case. After a long sequence of developments, the CBCID investigated the matter and examined the available evidence and related statements. On the basis of the findings of the investigation, an FIR has been registered against 12 police personnel. However, official confirmation is required on the full nature of the allegations, the roles of all named police personnel and the detailed sections mentioned in the FIR.

Action has resumed in a nearly 35-year-old case. In old criminal cases, fresh action can be taken when new facts emerge during investigation and legal proceedings. In this case too, further process has begun after the investigating agency’s report. The role of the police and the concerned investigating agencies will now be important.

The registration of an FIR does not amount to a person being held guilty. The responsibility of the accused police personnel will be determined only on the basis of the investigation, available evidence and the judicial process.

All eyes will now be on the judicial process. The filing of an FIR in a case nearly three and a half decades old has raised hopes of justice for the victim’s side, while also bringing questions of impartiality and accountability in the investigation to the fore. It will be important for the further investigation to clarify what actually happened during the alleged encounter and what role was played by whom.
