CNN Central News & Network-ITDC India Epress/ITDC News Bhopal: Trinamool Congress founder and former West Bengal Chief Minister Mamata Banerjee has moved the Supreme Court challenging the Election Commission of India’s interim decision to freeze the original Trinamool Congress name and its reserved ‘Flowers and Grass’ election symbol. The plea was filed after the poll panel intervened in an internal dispute between rival factions of the party.
The Election Commission had on September 17 ruled that both factions could not use the name “All India Trinamool Congress” or the reserved symbol for the upcoming by-elections. The Commission said the competing claims required substantive determination under Paragraph 15 of the Election Symbols (Reservation and Allotment) Order, 1968.
For the October 6 bypolls in Nandigram and Rejinagar, the poll panel subsequently allotted Banerjee’s faction the name “Mamata All India Trinamool Congress” and the ‘Football Player’ symbol. The rival faction led by Arup Roy was allotted the name “Democratic Trinamool Congress” and the ‘Envelope’ symbol.
Banerjee has challenged the interim arrangement before the apex court, seeking legal relief against the EC decision. Her petition names the Election Commission and representatives of the rival faction as respondents.
The Supreme Court plea is expected to be mentioned for urgent listing before the Chief Justice-led Bench on September 21. Meanwhile, the Election Commission’s substantive proceedings concerning the competing claims over the party’s original name and symbol remain pending.
