Questions have been raised over the bench and roster-based listing of the case after the Supreme Court hearing on petitions filed by Noida District Magistrate Medha Roopam and the Uttar Pradesh government. The petitions were filed against an Allahabad High Court order that had quashed the detention of student Akriti Chaudhary under the National Security Act.
On September 23, the matter was heard by a bench of Justice Satish Chandra Sharma and Justice N.K. Singh. According to a LiveLaw report, under the Supreme Court roster in force from July 13, 2026, matters related to habeas corpus and preventive detention have been assigned to the first four benches in order of seniority. These include the benches of Chief Justice Surya Kant, Justice Vikram Nath, Justice B.V. Nagarathna and Justice M.M. Sundresh.
Questions have also arisen because some other detention-related matters linked to the Noida workers’ protest are already pending before a bench headed by Justice B.V. Nagarathna. The petitions filed by Medha Roopam and the Uttar Pradesh government have also been placed in the category related to preventive detention, but this category does not appear in Justice Sharma’s regular roster list. However, his roster does include a provision for specially assigned matters. Available reports have indicated the possibility that this case was assigned on that basis, but no clear public explanation has emerged from the Supreme Court administration in this regard.
During the hearing, the Supreme Court granted an interim stay on the Allahabad High Court order. The High Court had held Akriti Chaudhary’s detention to be illegal and directed that compensation of Rs 5 lakh be paid from Medha Roopam’s personal salary. After the Supreme Court’s stay, that direction is not effective for the time being. The case has now intensified discussion over roster-based listing, already pending related matters and the procedure for special allocation. The Supreme Court has reserved its decision for further orders in the matter.
