New Delhi: Lawyers and court staff in Delhi-NCR have got relief from the entry ban on pre-BS-VI vehicles imposed in Delhi to control air pollution. The Delhi High Court has conditionally allowed non-Delhi registered vehicles older than the BS-VI standard to enter the capital. However, the exemption will apply only on court working days.

Justice Amit Mahajan passed the order on Friday while hearing a petition filed by the Delhi High Court Bar Association (DHCBA). The bar association had urged the court to allow lawyers living in various NCR cities, including Gurugram, Faridabad, Noida and Ghaziabad, to come to Delhi in their vehicles.

Association president and senior advocate N. Hariharan argued before the court that a large number of lawyers live outside Delhi and regularly come to the capital to conduct cases. Because of the vehicle restrictions, their timely presence in courts could be affected. This could also cause difficulty for judicial work and litigants.

Notably, the Delhi government has banned the entry of pre-BS-VI vehicles registered in other states into Delhi from 1 November 2026 to 31 January 2027 for pollution control. Under this rule, old petrol and diesel vehicles registered outside Delhi are not permitted to enter the capital.

However, the relief granted by the High Court does not provide exemption from restrictions imposed under GRAP. Compliance with other applicable pollution control rules and the requirement of a valid Pollution Under Control Certificate (PUCC) will remain necessary. The court order is expected to bring relief to lawyers and court employees who travel from NCR to Delhi for regular judicial work.
