CNN Central News & Networks / ITDC India ePress / ITDC News /Agencies/ Bhopal: Preparations for a ‘people’s impeachment’ against Chief Election Commissioner Gyanesh Kumar; Kharge to present proposal

New Delhi. The opposition is preparing to intensify its protest against Chief Election Commissioner Gyanesh Kumar. Opposition parties, under the leadership of Congress president Mallikarjun Kharge, are preparing to bring a proposal to initiate an impeachment-like process against him. The opposition has named this initiative a ‘people’s impeachment’. However, from a constitutional and legal perspective, the process for removing the Chief Election Commissioner from office is different from a normal impeachment.

Discussion on the proposal among opposition parties: The opposition alleges that the functioning of the Election Commission and some of its decisions have raised questions over its impartiality. Opposition leaders are particularly expressing dissatisfaction over issues related to the special intensive revision of electoral rolls and the electoral process. Through the proposal, the opposition is planning a strategy to raise these allegations in Parliament and on public platforms.

Kharge’s role is important: Congress president Mallikarjun Kharge may play a coordinating role among opposition parties in this initiative. Efforts are being made to bring MPs from various parties together in support of the proposal. The opposition’s objective is to trigger a wider debate on questions linked to the accountability of the Election Commission and its constitutional independence.

Constitutional process for removing the Chief Election Commissioner: Under Article 324(5) of the Indian Constitution, the Chief Election Commissioner can be removed from office only through the prescribed procedure and on the same grounds as a judge of the Supreme Court. For this, a motion must be passed by a special majority in both Houses of Parliament. Therefore, the ‘people’s impeachment’ is being seen as a campaign of political protest and mobilisation of public support, while the formal process of removal from office will take place only according to constitutional provisions.
