CNN Central News & Network-ITDC India Epress/ITDC News Bhopal: New Delhi. The Supreme Court will today hear two petitions filed over the functioning of Chief Election Commissioner Gyanesh Kumar. The petitions have raised several questions over decisions linked to the Special Intensive Revision, or SIR, the Election Commission’s decision-making process and technical arrangements.
The matter will be heard by a three-member bench headed by Chief Justice Surya Kant. The petitioners have alleged that around 14 decisions related to the SIR were taken despite alleged objections from other election commissioners. The petitions also refer to alleged dissent recorded by Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi. However, the Election Commission has presented a different position on these claims.
One petition has sought interim directions restraining Gyanesh Kumar from exercising his powers and allowing the Commission’s functioning to be carried out through the other election commissioners until the hearing in the matter is completed. The petitioner has also questioned whether the Chief Election Commissioner alone can exercise the collective powers of the Election Commission.
The petitions have also sought a forensic examination of technical changes linked to the SIR, ECINet and ERONet, preservation of original records and an independent inquiry into alleged irregularities. One petition has sought the constitution of a special investigation team or a judicial commission to examine allegations that around 13 crore names were deleted from the voter list. All these allegations are currently part of the claims made in the petitions and are to be heard by the Supreme Court.
