The FIR, filed in Uttar Pradesh, alleged that Pratapgarhi’s post contained content capable of disturbing communal harmony. However, the apex court observed that the content in question fell within the ambit of permissible expression under Article 19(1)(a) of the Constitution.

A bench led by Justice Abhay S Oka emphasized that judges have a constitutional duty to protect freedom of speech and expression unless there is a clear and imminent threat to public order. The judgment reiterated the need to uphold civil liberties even in politically sensitive contexts.
