CNN Central News & Network-ITDC India Epress/ITDC News Delhi: NEW DELHI: The Supreme Court on Tuesday, October 27, 2026, deferred further hearing on a batch of petitions challenging the functioning of the Election Commission of India (ECI) and the decision-making role of Chief Election Commissioner Gyanesh Kumar. The court granted the petitioners 10 days to respond to the counter-affidavit filed by the poll panel, postponing further proceedings until after the Diwali break.
During the hearing, senior advocate Vikas Singh, appearing for petitioner Rakesh Kumar Singh, told the Bench that the Election Commission’s response had been received only the previous night. He sought additional time to examine the affidavit and prepare a detailed reply. The court accepted the request and allowed 10 days for the response.
The petitions question whether the Chief Election Commissioner took certain decisions unilaterally on matters that allegedly required collective approval by the multi-member Commission. They particularly concern decisions related to the Special Intensive Revision (SIR) of electoral rolls. Some petitioners have sought judicial scrutiny of the Commission’s records and action against the alleged procedural irregularities.
The Election Commission has rejected the allegations, maintaining in its counter-affidavit that the relevant SIR decisions were taken unanimously by the CEC and the two Election Commissioners. It has also disputed claims that the revision process involved unauthorised changes to voter-registration procedures.
The proceedings also involve petitions filed by Rahul Gandhi and other opposition leaders seeking scrutiny of the Commission’s functioning. The court has not delivered a final ruling on the allegations.
The case raises important legal questions about collective decision-making, institutional accountability and the procedures governing electoral-roll revision. The Supreme Court will consider the matter further after the petitioners submit their replies.
