CNN Central News & Network-ITDC India Epress/ITDC News Bhopal: The Trump administration is preparing a major change for foreign employees working in the United States on H-1B visas. The US Department of Homeland Security (DHS) has proposed ending the 60-day grace period available after a job loss.
Under the current rule, H-1B employees can remain in the United States for up to 60 days after their employment ends while they look for a new job or another visa option. If the proposal is implemented, affected employees may have to leave the United States as soon as their job ends, unless they have another valid basis to remain in the country.
The change could also affect some other categories, including L-1, O-1, E-1, E-2, TN, H-1B1 and E-3, apart from H-1B.
The proposal could have a particular impact on Indian professionals, as a large number of Indian technology and IT professionals are part of the H-1B programme. Companies may also find it difficult to manage employees’ immigration status in the event of sudden job terminations.
However, the change has not yet become a final rule. Public comments will be invited on the DHS proposal, and it can be finalised only after that process. Until then, the existing 60-day grace period remains in effect.
