The United States has announced new visa restrictions to tighten controls on birth tourism aimed at securing US citizenship for children. US Secretary of State Marco Rubio announced the new policy on September 23. The policy targets people who knowingly engage in or facilitate birth tourism.
Under the new policy, action may be taken against owners, operators and managers of commercial birth tourism networks, as well as visa agents who prepare applicants to provide false information or commit fraud. Medical service providers overseas who knowingly promote such travel or the alleged fraudulent use of government health assistance may also come under its scope. The US State Department said the step is aimed at monitoring the immigration system and preventing fraud in the visa process. The new policy has been implemented under Section 212(a)(3)(C) of the Immigration and Nationality Act. In some cases, family members of the individuals concerned may also come under these restrictions.
The use of tourist visas for birth tourism in the United States is already not permitted. According to the US State Department, if the primary purpose of a person’s travel is to give birth to a child and thereby obtain US citizenship, it is not a valid basis for issuing a tourist visa. The US administration had also issued an executive order in August 2026 to stop birth tourism. It provided for steps such as withholding or cancelling visas or travel authorisations, or denying entry, for people attempting to come to the United States for the purpose of birth tourism.
